Research On Patent Issue In The Condition Of Cloud Computing

Cloud computing is a major technological revolution after the internet informationindustry. With the development of cloud computing technology, the impact of cloudcomputing is beyond the restraint of the technology. Further it impacts on the economicstructure and superstructure profoundly. Cloud computing technology integrates largescale, virtualization, highly scalable, on-demand services, and more. Therefore, traditionalpatent system is no longer adapted to the development needs of cloud computing. Underthe cloud computing environment, the investigations of patent issues is necessary. In thisthesis, from the perspective of the patent, related issues about cloud computing are studiedand some suggestions are given.Firstly, the development of cloud computing technology in domestic and internationalare discussed. Meanwhile, the definition and characteristics of cloud computing areorganized and rationalized. On this basis, the current cloud patent system of the developedcountries is summarized. By contrast, the shortcomings of our current cloud patent syste mare analyzed, and corresponding countermeasures are given.Secondly, two important topics of cloud patents, business method patent issue andgraphical user interface patent issue are discussed in detail. Characteristics, substance,legislation and problems based on business method of cloud computing are studied andanalyzed. Development process, access systems of mainstream country, regulations andinsufficient of our legal system about the graphical user interface of the patent system aredescribed, and corresponding improvements are suggested.Finally, contents of this thesis are summarized. Key issues in the cloud computingenvironment are improving legislation and establishing industry system. The balancebetween the possibility and reality of prospective legislation should be noted inimprovement of legislation. Not only the room for possible future patent needs is reserved,but also fairness is focused on. In establishing industry system, the relationship betweenindustry standardization and industry scale should be noted. Furthermore, healthydevelopment of the industry and the rational allocation of resources should be directed.
