Legalization of euthanasia is a product of modern society, human beings are morerational understanding of life, is a manifestation of the development of humancivilization and progress. However, in China, the practice of euthanasia behavior isdeemed intentional homicide, resulting in a conflict of reason and jurisprudence.Legalization of euthanasia is real needs of the community, is a manifestation of thefundamental rights of citizens, thus legalizing euthanasia author of this article is a studyof the topic.In addition to the introduction and conclusion of this article is divided into fivepartsThe first part provides an overview of the concept of euthanasia, classification andhistorical development, recalled the Chinese debate about the legalization ofeuthanasia.The second part of extraterritorial legislation of euthanasia were investigated andassessment, discussed the Implications for China euthanasia legislation and reference.The third part, Analysis of the convicted and acquitted of two judicial precedents,from the standpoint of jurisprudence analyzes the problems in judicial practice.The fourth part, from the real needs, rights embodied the spirit of moderncivilization and humanitarian aspects analyzes the necessity of legalization ofeuthanasia; simultaneously from material security, the victim agrees, socialpsychological and social point of view of the dangers of legalizing euthanasiafeasibility.The fifth part, mainly on the legislative design of euthanasia. Perfecting therelevant provisions of the Criminal Code and the development of "euthanasiaregulations " put forward concrete proposals to legalize euthanasia in two ways.Finally, we summarize the legalization of euthanasia in our country will eventuallyrealize is an inevitable trend.
