| Motor vehicle, as they bring convenience to people, they also cause property lossand even personal injury because of their defects. However, Chinese recall system ofdefective products of cars is not perfect enough. The contradiction between the protec-tion of consumers’ rights and the imperfections in the defective cars’ recall system isincreasingly severe. On Mar.15th,2004, China issued the Administrative Regulations onRecalls of Defective Automobile Products. It marks that the establishment of the recallsystem in China. The Defective Automobile Product Recall Management Regulations,which issued on Oct.30th,2012, makes some progress relative to the AdministrativeRegulations on Recalls of Defective Automobile Products, but it also has many limita-tions and needs continued improvement.This essay is based on the analysis of the basic theories of the recall system of de-fective cars. It mainly has three parts. The first part is the introduction of Chinese recallsystem of defective cars and its current situation, including three development stages ofthe recall system and the major coverage and primal problems of the recall system.Second part is based on the foreign recall systems of defective cars, introducing the re-call systems of some developed countries, like the USA and Japan, mainly related totheir complete legal systems, effective regulatory systems, severe punitive measures,advanced information systems and their authoritative technical detection systems. Thelast part is the focal point of the essay. It proposes strategies to improve the recall sys-tem of defective cars aiming at the the deficiency of Chinese current recall system. |
