On The Procuratorial Supervision Of Civil Implementation In Our Country

In recent years, in our judicial practice of civil execution，disorderexecution is a big problem that we are facing and this has become a bigproblem for the construction of the rule of law society in China. It alsoharms the legitimate rights and interests of people, and affects therealization of the goal about judicial fair and judicial authority． Becauseof the inherent disadvantages of supervision the court itself has,establishing a strong external supervision mechanism is necessary for theimplementation of the civil execution. The author suppose that thePeople’s Procuratorate has its own advantage as a special organ for legalsupervision, therefore we should clearly stipulate the supervision powerof the People’s Procuratorate in order to build perfect prosecutorialsupervision of civil implementation．This paper makes a rational analysis of prosecutorial supervision ofcivil implementation from different point of views. The article includesthree parts， introduction，the main text and the concluding remark．The text is composed by four chapters．Chapter1makes a overview of civil implementation supervisiontheory．After defining the concept of“prosecutorial supervision of civilimplementation”，the author discusses its characteristics. Then chapter2discusses the present situation of the supervision civil implementationand the importance of establishing the prosecutorial supervision system.In chapter3,the theory and practical basis of the system is discussed, andthe author expounds the feasibility for setting up the supervision of civilenforcement． The last part introduces the concrete measures about howto set up the system. We should adopt different kinds of ways tosupervise according different situations.
