China’s Rural Left-behind Children Entrust Guardianship Problems Research

Rural left-behind children is the special product of reform and open-uppolicy. Due to house register regulations and economic standard,ruralparents entrust aged parents or closed friends to take care ofchildren.However, an obvious phenomenon is that most rural children cannot be custodied well.More and more rural children has legal rightsdestroyed.As for the rural children guardianship,no particular regulations could befound in our law system.Although the minors guardian system can beused,we should also establish the entrusted guardianship system for thespecific characteristics of the rural children.Although《The Civil Law General Principles》has approved the Regimein its twenty-second article,we still need conduct an entrust monitoringsystem due to the abstract and empty legal clauses.First in view of thecontract relationship essence of the entrust guardianship,the completeentrusted guardianship system should contain several basic points such as the establishment mode of the entrusted contract,the mission and duty,etc.Inaddition,we should also establish a matching and perfect custody supervisionsystem to ensure the healthy function of the system and to guarantee that therural children is custodied in an effective way,which is an inevitable choiceof the security target of the entrused guardianship system.
