In Terms Of Flawand Legal Countermeasures Of Non Standard Format Of The Bank Guarantee

With the increasingly intense competition in the banking industry, inorder to maintain market share, consolidate cooperation relations andincrease the rapid development of business, the bank have to providepersonalized service for different customer. Modifying the standard textin accordance with the requirements of the applicant or beneficiary ofletter of guarantee is one of the service.The first part of this paper introduced the basic theory of nonstandard format of bank guarantee, from the concept, characteristics andthe difference with the bank guarantee standard of text. And alsoanalyzed the necessity of the prevention of non standard format bankguarantee clause defects from the realistic demand and the intrinsicmotivation. The second part elaborated on two important reason causingthe bank guarantee legal risk, which is guarantee scope and demand in terms of defects. Aiming at the defects caused by the terms of thelegal risks, the third part of this paper put forward the legalcountermeasures and suggestions, through strict amendment andperfection of legislation to control bank of non standard guarantee legalrisk.
