Surrogacy as a kind of artificial reproductive technology plays ansignificant role in the solution of infertile women,but since there existsdispute in terms of practice and ethics, the scholars are divided amongthemselves without a uniform answer.As a result, some countriespermit surrogate while others prohibit surrogate. In China, surrogatetechnology is forbidden to be implemented, but in the surrogatetechnology there exists a large number of potential demand in reality inour country.The number of children through surrogate birth also increased.Identifying the parent-child relationship is the first step to protect thelegitimate interests of the surrogate-birth children, because of theimportant legal and social significance for the surrogate child’sparent-child relationship.This article,besides the introduction, is divided into four chapters Chapter one “Overview of artificial reproductive technology andparent-child relations,” introduced the concept of artificial reproductivetechnology and the relationship between parents and children. anintroduction on the species identified for traditional parent-childrelationship, next on the concept and classification of artificialreproductive technology. Finally, artificial reproductive technology hasgreat impact on the traditional parent-child relationship, among which theimpact of the surrogate technology on the traditional parent-childrelationship is the largest.Chapter two “Identification of relationship for foreign surrogatechildren”, introduced other countries’legislation on parent-childrelationship of surrogacy and related theories.Chapter three “The legislation practice and theory of therelationship between,”surrogate children in China, further elaborated onChina’s surrogate status and problems, and on our country’s legislation,judicial practice surrogacy and Chinese scholars’ opinions.Chapter four “Feedback on identification of our country’s surrogateparent-children relationship,” Through analysis of deficiency in thesurrogate-related legislation and existing problems of Pregnancy paternityidentification and on this basis, through the analysis of the effective andinvalid surrogate agreement,we put forward the surrogate parenthood identification standards, and come up with our own views on how toperfect the identification of surrogate parent-child relationship.
