With the rapid development of our country’s economy, the rapid growth of the domestic highway mileage and the automobile capacity, our country has entered "the automobile society". In order to alleviate the increasingly heavy traffic management pressure, a large number of traffic assistant have appeared across the country. This group has played an important role in maintaining the traffic safety and keeping the traffic flowing. However, as there are many drawbacks in management, this group do some illegal and criminal activities. At the same time, the special identity of the traffic assistant brings some difficulties to the cognizance of the illegal and crime.Taking "the case of larceny of Mr. He et al." as an example, the article is on a more in-depth research on the traffic assistant related property crimes, which is divided into three chapters.In the first chapter, the article has carried on a brief introduction to "the case of larceny of Mr. He et al.". Surrounding the case, there are two focus issues, which have provided two veins for the later discussion.In the second chapter, the article carries on the legal analysis around the identity and behavior of the accused of Mr. Li, Mr. Wen and Mr. Xu and discusses the reason for not constituting the crime of Acceptance of Bribes, Bribery, Abuse of Authority, Official Embezzlement or Stealing and identifieds the behavior of illegally deleting traffic points. Finally, the article thinks that it is appropriate that the accused’s acts constitute crime of fraud.In the third chapter, basing on the analysis of the preceding text, the article puts forward a few suggestions on how to improve the identification of the traffic assistant related property crimes.
