With the development of science and technology, the Internet has become an important part of people’s life and one of the main methods of information flow. Internet age Gives great convenience to people’s lives with giving rise to a set of new legal issues. Internet defamation problem is one of them. Although in essence, Internet defamation and traditional defamation is the consistent. They all belong to the category of personality rights. But the particularity of the network Makes the network defamation created new problems to differential treatment.Taking Internet defamation as a research object, combined with the current reality of the situation, this article is divided into four parts altogether. Starting from the meaning of network infringement, defamation, and network reputation, chapter one obtains an overview of the network defamation, Which should be noted that the special nature of the network reputation infringement. The second chapter discusses the identify of network defamation mainly. It includes the determination about two subjects of the network defamation and four elements of network reputation infringement. The third part mainly discusses the network reputation tort imputation principle and justifications. Principle of fault liability is the key in Responsibility Principle. Defenses discusses separately from two principal of the network user and network service providers. The fourth chapter is the reflections on network defamation problems. First of all, it gives the reflections on the boundaries and the Equilibrium about freedom of speech and network reputation protection Then it is the proposal of improving the network defamation legislation. Finally, it is the thought of promoting network autonomy and the angle turns heteronomy into discipline.
