With the rapid development of the economy, genetic research entered into a deeper stage. The rapid development of the genetic technology pulled out close relationships between diseases and genes. Thus, a new discrimination came out—genetic discrimination. The so called genetic discrimination is one kind of injustice in working, studying, living and many other fields because of someone’s body carries "defective genes" or "bad genes". This paper mainly discusses the genetic discrimination in employment.Currently, our country hasn’t yet made laws related to genetic discrimination, however, with the development of the genetic testing technology, people can get others’genetic information simpler and faster. We will encounter with more and more genetic discrimination and all kinds of related society issues. In 2009, the first case happened in our country which forced the theoretical circles and the judicial circles to pay attention to genetic discrimination. But in the world, many countries such as American, Australian, Norway have passed the law of genetic discrimination one after another to regulate genetic discrimination and the using of genetic information.This page first states the concept and feature of genes, and then concludes the present characteristics of foreign legislation and revelation to China through detailed comparative analysis of the legislation of genetic discrimination between American and Australia in job hunting fields. And last, analysis the difficulties of the first case of genetic discrimination and discuss the related law issues in-depth, so that we can put forward feasible suggestions to Genetic Information Nondiscrimination Act.
