| At present, a lot of certified construction units do not work on construction of projects, but to lend certification to gain profits. So, a lot of inexperienced construction teams become actual constructors. Disputes are arisen in completed settlement owing to appearance of a lot of invalid contracts. As for legal issues on settlement of engineering funds like how to settle engineering funds under invalid contract, the influence of working quantity to settlement of engineering funds, the responsibilities and risks undertaken by building unit and construction unit and whether the price sent to a higher level for approval can be regarded as the basis of settlement directly, there are different views and disposal ways in actual cases. China issued new demonstration text of construction contact in 2013 again by referring to mature experience of foreign countries. This paper stated practical legal issues on disputes arisen from settlement of engineering funds according to actual judicial cases and in combination with the new demonstration text of contract, aiming to make judicial and hearing affairs more operable. |
