Research On The Abolition Debate Of Introducing Bribery Crime In The Perspective Of Typical Cases

Introducing bribery, with its special means of behavior and the special role which goes throughout the bribery crime chain, is attached with great importance by law experts and even by the whole society. However the abolition debate of introducing bribery crime goes over endlessly, which leads to ambiguous judging standards in the judicial practice. In order to make contribution to abolition theory of introducing bribery crime, this essay will introduce the foundation of abolishing introducing bribery in a judicial practicing way and provide several feasible suggestions on abolishing crime of introducing bribery by analyzing the two perspectives, reserving or abolishing crime of introducing bribery, and related previous cases.This paper consists of introduction, main body, and epilogue, and the main body has three points. First point is the two perspectives of introducing bribery crime, reserving or abolishing. Second point suggests the crime of introducing bribery should be abolished, in the study of typical actual cases perspective. By affording sufficient grounds, including two actual cases discussed in detail and statistical data of filed and sentenced cases in introducing bribery crime field since 2012, this part of the article argues that crime of introducing bribery and bribery common crime can be hardly distinguished from each other. Also according to the statistical data, rare suspects were convicted of introducing bribery crime. Therefore, the theory that crime of introducing bribery should be abolished and replaced by bribery common crime is strongly supported in this part. Point three offers several suggestions to repeal and re-build the dilemma of abolishing crime of introducing bribery, through the concept level, the legislative level and a practical judicial level.
