The fourth plenary session of the party’s 18th central committee have passed 《The decision of the CPC Central Committee on the comprehensive promotion of several major issues of the rule of law》. This decision put forward establishing The Constitutional oath system. It indicates the direction for establishing a unified Constitution oath system in China. There are many countries have established The Constitutional oath system now. The practice of oath in modern and Contemporary provide the basis of practice for establishing a unified Constitution oath system in China. Although The Constitutional oath system have not been institutionalized in China, there have been some documents that regulate the oath activities.The Hongkong Special Administrative Region and the Macao Special Administrative Region have regulate the oath system in the basic law. In previous years, there are some proposals relevanting The Constitutional oath system.In terms of the existing foundation and the realistic need, we have the basics of establishing The Constitution oath system.This paper provide the effect of Constitution oath. Establishing a unified Constitution oath system is important for the rule of law,the restriction of power and the construction of democracy and legal system.
