Construction Of Character Evidence In Community Corrections Programs Referee

“Community Correction” is an "import" from abroad, while there are subtle differences among the definitions of the Community Correction in related studies in different countries, it has made great contribution to the development of modern civilization and the criminal policy. Community correction has been translated into Chinese as early as in the 1980 s, it is derived from “Community Corrections” or” Community –Based Corrections” in English. The legal practice of the “Community Correction” has sown its seed in 2003 in China. In 2003 the supreme people’s court, the supreme people’s procuratorate, ministry of public security and the ministry of justice jointly issued the notice about carrying out community correction pilot work(hereinafter referred to as both the house and senate "notice") was the first authoritative documents about Community Correction. In 2011, through the criminal law amendment(eight), Community Correction was written into the criminal law and formally become a legal concepts in the Chinese judicial system.The first draft version of Community Correction Law formed in 2014, and it is expected to be issued from the authorization in 2015.Based on the idea character evidence rules which was introduced in the theories of community corrections, the article firstly issue the requests in respect of character evidence in the Community Correction decision making process, and attempted to discuss how to apply the character evidence rule in the community correction, and how to make more contribution to the community correction. The article would like to discuss how to make the character evidence rules into practice, such as sentencing probation and parole process.While I expect that the adoption of community corrections in a different analysis of the application of character evidence rules, so as to better service to community corrections for the character evidence rule provides a theoretical basis. I think the character of community correction decision should include three aspects: the actor’s personality, behavior and social environment on objective reflection of the perpetrator, or evaluation.
