Research On The Shensi-kansu-ningsia Border Region People’s Participation In Judicial Way

The Shensi-kansu-ningsia Border Region Government try to set up a new judicial system, which adopted the mass line and mobilized the public to participate in the judicial activities suitable for the situation of China at that time. The popularization of judicial system which took in the Shensi-kansu-ningsia Border Region achieved good effect, modernized the Chinese legal system, brought new judicial ideas and practices, started a new chapter in the modernization of Chinese legal system nearly. Eventually, It became the skeleton and soul of the legal system in China and still has a long influence and vitality.The Shensi-kansu-ningsia Border Region Government took the mass line and set up popularization of judicial system in which there were some successful experience and some experience worthy of reflection. The history judicial experience helped to expand the rational and orderly participation in judicial in the modern society. As we all known, History is the logical starting point of the present theory, thus this thesis research the people participate in judicial practice in the Shensi-kansu-ningsia Border Region, which favor to draw lesson from the history experience, understand the initial purpose of the judicial system and provide methods and direction for the current judicial reform. In order to realize democratic and fairness judicial and the perfect judicial power operation mechanism, social harmony and stability, the thesis will provide legal, institutional and historical reference.This paper is concentrated on the Shensi-kansu-ningsia Border Region during the Anti-Japanese War, take the operation mechanism of people’s participation judicial power as the object of study, including the main trial system and the jury system. The Paper embarks from the period of the trial and the jury system, combined with the case to trial and the jury solutions, draw the outline of the people’s participation in the judicial trial, operate in the procedural process, analyze the social effect, put forward constructive suggestions, draw the historical reason on trial system exiting and the value of jury system in the current judicial practice.This paper is divided into five chapters. The first chapter focuses on the popularization of judicial system in the Shensi-kansu-ningsia Border Regionl, trying to achieve a general overview about ir. The second chapter study the people to participate in the operation mechanism of judicial judgment from the perspective of the trial system. The third chapter study how people’s jurors participate in the judicial system, analyze the advantages and disadvantages of people’s jury system, develop the functions and role of people’s assessors in the realistic judicial reform. The fourth chapter introduces the other ways of the people involved in justice in the Shensi-kansu-ningsia Border Regionl, such as the people’s mediation system and the prosecution system. Chapter Five summarize and evaluate the people’s participation in judicial way in the Shensi-kansu-ningsia Border Regionl.
