Automobile industry is one of the supporting industries that represent the country’s industrial level and its development could push the country economy forward. With the development of economy and the progression of the age, automobile has become an indispensable tool in people’s daily life. It has been over a decade since the 4Spattern entered Chinese market, and it has an irreplaceable effect on the formation and development of Chinese automobile sale market. However, compared with those developed countries which already have a solid foundation of automobile history, our country’s automobile market is still at an early stage. Due to this aspect, the 4Ssales pattern is receiving approvals, as well as controversies at the same time.At the beginning of foundation, 4Smodel of car manufacturers serve to enhance brand value, promote automobile consumption, and establish the role of loyal customers.However, in the year of 2005, the introduction of "Auto brand sales management implementation approach" exacerbated the imbalance between the main car markets.Car manufacturers in the industry chain are becoming the more powerful party, via a vendor control of car sales market, dealers and consumers legitimate rights. At the same time, this model also limits the effective competition in the automotive markets, in which the long-term development of the automotive industry has posed a negative effect.With China’s Anti-monopoly law was being promulgated in 2008, the restriction of competition caused by automobile 4S model should be regulated. However, due to the fact that current law was only enacted a short time ago, there are still a number of system design imperfections. For this, the author suggests that it can be refered to a more mature market economy abroad. Antitrust regulation means for the automotive industry in many countries can be used as a guide for China’s antitrust laws completion.Specifically, they are illegal and reasonable principle in the United States, the safe harbor system for monopoly market share in the EU, and unfair trade separate regulation in Japan.At present, in the model of China Automobile 4S and its regulation formonopolistic behavior, Anti-monopoly legislation itself contain plenty of flaws. Auto brand sales management approach exacerbated the imbalance in the main market. The monopoly regulation is more difficult to be carried out due to the malfunctions of the relevant law enforcement agencies and the Anti-monopoly Committee. In this aspect,valuable experiences from abroad mentioned above are considered as an important factor in the implementation of imperfect legislation, as well as the enforcement of the Anti-monopoly law.The chaotic status of China’s auto market 4S model for regulation can be improved from the following aspects: First, further improvement should be carried out on the Auto brand sales management approach, changing its imbalanced specification of market players; Secondly, there should be the introducing of a specific anti-monopoly law with the implementation details of monopoly regulations; Plus, the learning system from antitrust cases should be established, which helps to relieve the plight of antitrust situation; Finally, people should be encouraged to participate in private antitrust litigation lawsuits which protect the legal rights of unprotected bodies.
