Adult Guardianship System Of Japan In The View Of Legal Guardianship

In Japan, having entered into the aging society, the people whose ability capacity for action have been restricted due to the lost the ability of identification, can protect themselves through the legal system. This system is so called the adult guardianship system. This system in act consists of legal guardianship system and arbitrary guardianship system.This report analyses the basic concept and modeling of the system concerned with the implementation of this new system since 2000, and the relationship between the legal guardianship system and arbitrary guardianship system. Through the analysis of the relationship of the guardian, protection and assistance those three systems, the study explains the basic structure, contents and characteristics. The study gives a subjective evaluation of the implementation of the facing project and the experiences. To the problems of adult guardian system in our civil law, we propose a solution for a legal refereciable model in the adult guardianship system for our country, under the mono-system.
