| With the development of economy and society, there are more and more people in the city, but less and less land can be used in the city. The voice of “asking space for land” is increasingly strong. With the rapid development of science and technology, the vertical use of land space becomes available. Efficient using of land space depends on the relevant legal system to establish and perfect, while space land rights registration legal system is particularly important which as a protection of property rights and transaction security. But China does not have specific legislation on land space right registration. Only some economically developed areas have some local exploration. Under the background of the gradual establishment of a unified real estate registration system, it is necessary to establish a land space rights registration system. It has important practical and theoretical significance.The paper is divided into four sections to analysis land space rights registration legal issues:The first section is the basic theory of land space rights registration. This section analyzes whether land space right can register, land space right registration’s special features and significance.The second section is the status quo of China’s land space registration system. This section analyzes land space registration system from both the state laws and local regulations. In this section, the writer also analyzes problems of China’s land space registration system.The third section is the extraterritorial legal system of land space registration and relevant experience. This section analyzes the extraterritorial legal systems of land space registration, and makes some recommendations based on relevant experience.The fourth section is the improving China’s land space registration system. In this section, the writer discusses the necessity of improving the registration system of land space, and explores how to improve the registration system of land space and how to deal with related system. |
