On Comprehension And Application Of The Crime Of Contract Fraud

The crime of contract fraud to the act in which for the purpose of illegal possession,the party fraudulently defrauds the properties of relatively large amount of the other party in the conclusion and execution of the contract.The crime exists in the understanding and application of the following main challenges:the crime of fraud identified,accomplished recognized standards identified, as well as the purpose of illegal possession of identification.In order to understand and apply to contract fraud, and more in line with the purpose of criminal law and social justice, we must address these problems.This paper is a case study based Master’s Thesis,describes from the following three aspects.The first part of this paper is the introduction of the case, and make a list of the three focus of controversy in this case.The second part of this paper is on the application of law and case;In this part, the author firstly describes the determination of fraud,followed by discussion of the standard of accomplishment of crime of contract fraud, the final analysis of the identification of the purpose of illegal possession.The third part of this paper is a case study conclusions and recommendations;In this part, the author summarizes the following problems:Firstly, whether the defendant constitutes the crime of contract fraud; Secondly, if the defendant in this case constitutes a crime, how to determine the amount of crime; Thirdly, if the defendant in this case constitutes a crime, the crime is accomplished already;Finally, if the defendant in this case constitutes a crime, should be how to sentencing.
