On The Improvement Of People’s Mediation System From Comparative Laws

People mediation institution is a legal institution with Chinese characters and is reputed by western scholars as “Oriental Experience”. It plays an important role in promoting social harmony and to assist the local judiciary reduction of litigation. Because of the characteristics of people’s mediation is the most frequently used to resolve disputes way, it is very important to resolve social disputes and an important part of China’s diversified dispute settlement mechanism. But in recent years,with the development of society disputes becomes more and more complex, the limitations of the people’s mediation system constantly exposed. Therefore, we need improve the people’s mediation system to deal with all kinds of disputes, so that it can better serve the people and serve for the development of the socialist harmonious society.The first chapter is an overview of the people’s mediation system, we analyze the concept of people’s mediation system, characteristics,necessity, significance, principles. The second chapter is about the history of mediation system, We analyze the development process of mediation system and summarize the development of people’s mediation system after the founding of New China. The third chapter is the development and enlightenment of foreign and Taiwan mediation system to make a detailed statement. We further introduce mediation system in the United States and Germany, and then we discuss the organization township mediation, mediation program, mediation effect. Finally, we put forward personal views from various countries and regions of the mediation system. The fourth chapter carries on the analysis to the present situation and problems of the mediation system in our country. Through the analysis of the relevant provisions of the people’s mediation on theexisting laws and regulations, found that the nature of the problem of people’s mediation organization is not clear, the low quality of personnel,the mediation effect of funds and mediators of material can not be guaranteed and effect of the mediation agreement is low. The fifth chapter is to improve the people’s mediation system. Through the analysis of the fourth chapter, we combine with the advantages of mediation system of foreign countries and Taiwan region of China can be reference to find out.Gradually we determine the nature of the organization of people’s mediation system to improve the ability of people’s mediators to improve physical security measures to raise funds and also the effectiveness of people’s mediation agreement to solve the obstacles restricting the development of people’s mediation system.
