As the masterpiece of world’s literary giant Shakespeare, The Merchant of Venice is full of legal thoughts and ideas. It provides an inexhaustible source of inspiration for law and literature researchers and is highly valued by scholars of " not an age, but of all timeThrough compared research and history research method, legal and literature research approach, author refines three legal perspectives in the play. By analyzing the spirit of contract, "Amicus Curiae" System and the concept of equity that the play contains, writer extends out issues of the spirit of contract in China and Expert legal advice and explores traditional Chinese judicial principles of equity. Then through compared research and analyzing, this thesis provides some feasible justice suggestions to establish the spirit of contract, create and establish Expert Legal Advice System, achieve equitable justice and the integration of modern rule of law.This thesis consists of four chapters.The first part includes the introduction and chapter II, which interprets the basic situation of the merchant of Venice. Starting from the background of the play, author introduces the story of history, critical analysis and qualitative feedback from positive comments of the scholars on the merchant of Venice.The second part (chapter III) explores the delicate spirit of the Republic of Venice. According to traditional western contract, author discusses the semantics and connotations of the Western concept of contract and combines history, to contract law of our country’s construction and future development of the system comparison and reference. This chapter not only introduces specific provisions of the contract but also pays more attention to the research on concept of contract history reasons."Amicus Curiae" System is the third part of this article. In order to provide suggestions and opinions for the formulation and establishment of Expert Legal Advice System, author introduces "Amicus Curiae" System in western firstly, and supplements by "Amicus Curiae" System in comparison with our Expert Legal Advice.The last part of this article contains the concept of equity research which is related to legal interpretation. First, author discusses the Common Law and Equity. Then author compares similarities and differences between Chinese traditional equitable justice and United Kingdom equity in the three aspects of philosophy, value concept and legal profession. Finally, author provides constructive comments for China’s judicial reformation and construction of modern rule of law.
