Legal Protection Patterns Research On Chinese Intangible Cultural Heritage

Under background of cultural diversity, along increasing cultural interactions in the world, the influence and encroaching of strong culture on weak culture is also highlighted by all countries around the world. Security of intangible cultural heritage has become an important component in Chinese national cultural security, which relates to security of national cultural ecology, resources and sovereignty. However, as it is still not perfect for Chinese laws to protect intangible cultural heritage currently, it is urgent to accelerate the legislative process and carry out relevant legal practice. The paper takes the construction of the legal protection pattern of Chinese intangible cultural heritage under cultural security field, selects Northern Shaanxi folk art as an individual case to study, and advances the guarantee measures of the legal protection patterns of Chinese intangible cultural heritage in order to respond to cultural security challenge.The first part of the paper gives the research objective and significance of the paper, determines the research framework, defines the new vision of research preliminary, knows relevant theories of research, and lays foundation for future research; the second part establishes the theoretical basis for the research of intangible cultural heritage legal protection pattern through relevant basic theories and principles such as cultural security, intangible cultural heritage legal protection, etc; the third part analyzes the experience of intangible cultural heritage legal protection of developed countries and advances the enlightenment and reference of legal protection experience of developed countries; the fourth part studies the construction of intangible cultural heritage legal protection pattern under the cultural security vision; the fifth part illustrates the construction of public and private law protection pattern of Northern Shaanxi folk art aiming at the accomplishment and dilemma of Chinese intangible cultural heritage legal protection and the current legal protection condition of Northern Shaanxi folk art; the last part puts forward the guaranteeing measures of constructing Chinese intangible cultural heritage legal protection pattern under the cultural security vision. This paper wishes to advance effective measures to construct the complete intangible cultural heritage legal protection system under the challenge of cultural security problem through studying the intangible cultural heritage legal protection pattern.
