Studies On The China’s Volunteers Legislation

With the rapid development of society and economy, China’s volunteer service has improved greatly. It is known that volunteers can be seen in a lot of disasters. They try our best to contribute to improving China’s public welfare with noble moral integrity, not for the purpose of material rewards. However, volunteer service laws in China can not meet the rapid change of society and economy.Nowadays China has not establish a mature system of volunteer service. Theoretically, there is not a certain definition of "volunteers" accurately, which many scholars put forward their own different opinions on. The paper is aimed at studying the actual situation of volunteer service in China, and putting forward some suggestions for the development of volunteer service.The paper can be divided into four sections:The first chapter describes definition of "volunteers", volunteer organizations, volunteer service and the characteristics of volunteers. In the end, the paper stresses the significance of volunteer service.The second chapter provides an overview of volunteer legislation in China. By way of a list of qualifications for the right to the name of each local legislation and regulations, legislative structure, volunteer services, volunteers and volunteer organizations and volunteers, obligations were compared, summed for each of the volunteers Legislation species of defects, such as legislation name, legislative structure is not uniform, volunteer qualifications are not clear, volunteer rights, obligations inconsistent, tort liability is not clear and so on.The third chapter describes the situation of volunteer service legislation in United States, Britain, Germany, Japan and other foreign volunteers. Then the paper make a comparative analysis in volunteer service legislation.The fourth chapter is the conclusion of the paper, putting some ideals on the legislative structure in China. The paper discusses the qualifications of volunteers and volunteer organizations, the name and symbol of volunteer organizations. In the end, some legislative proposals are put forward.
