Reseach On Public Opinion And Judicial Justice

From Third Plenary Session of the 18th CPC Central Committee to the Forth Plenary Session, from the comprehensive deepening of reform to promote the rule of law, all of these demonstrate the determination and the strategy of the rule of law in china. In the context of the socialist concept of rule by law, the law becomes more and more close to the public, and the social public also gives more and more attention to judicial domain. And it results in a higher requirement on the judicial demands of fairness and justice in the nature of things.With the development of internet and media, the public likes expressing their views through these platforms more and more. The public opinion will have an impact on the judicial field while the public opinion can promote judicial justice, or interfere with the judicial justice. Meanwhile, the current way of judicial justice in dealing with the public opinion is too mechanical and passive, so that it cannot have good interaction between the two. Therefore, it is imperative for a further exploration and perfection focus on this topic.This paper consists of six parts. The first part is an introduction, elaborating on the source of the problem of the public opinion and the judicial justice, the purpose and significance of this research, major contents of the research, the present research status at home and abroad, and major research methods. The second part gives the definition of the public opinion and the judicial justice, the characteristics of public opinion and the characteristics of the judicial justice. Then, it gives a brief description of the relationship between the public opinion and the judicial justice. The third part describes that the public opinion is one of the factors that affect the judicial justice and analysis its reason. And we also describe what are the manifestations that the public opinion affecting the judicial justice. In the fourth part, we prove our view by some empirical research and theoretical analysis. In the theoretical analysis, we find that the faults that the judicial justice dealing with public opinion will directly affect the interaction between the public opinion and the judicial justice. The fifth part introduces the principle of interaction between the two, and then gives some suggestions to perfect our regulation of public opinion. We also carry on the deep discussion concerning how to promote the positive interaction between the two, and ultimately can make the public opinion to minimize the interference of judicial justice, so as to protect China’s judicial activities more mature and steady manner.The highlight of this article, combined with the introduction of the new regulations and the hot cases of judicial justice, is that we survey the ways the judicial justice responding to public opinion in a new and critical perspective.
