The rise and development of the internet has changed people’s way of life. Internet brings convenience and challenge to people. The global characteristics of the network broke the geographical restrictions of trademark. Internet has brought more opportunities for the development of the brand. But it also brings new challenges in the protection of trademark. Currently, in the internet environment, there appears many new types of trademark infringement. For example, trademark infringement caused by domain name, network link, search engine and so on. Due to the complexity and imperceptibility of network technology, these new trademark infringement behavior are also complex and subtle. Traditional trademark law cannot meet the needs of the trademark protection under the internet environment. This paper do some research and analysis on the infringement of trademark right in the internet.This paper is based on the traditional trademark infringement theory. Combined with the development of the internet.It traced the origin of the system and made a further studies on the theory and comparative analysis of advanced legislation and relevant precedents.This article could be divided into five chapters. Chapter one is introduction. The second chapter introduced the overview of trademark infringement in the internet, including the concept, characteristics and new types. The third chapter analyzed the legal regulation of infringement of trademark right in the internet. It introduced the inadequacies of the current trademark protection. The fourth chapter introduced the comparative law of the trademark infringement in the internet. It introduced the judicial precedents and legal regulation about this issue of the main foreign countries and relevant international organizations. The last chapter puts forward some suggestions to improve trademark protection in the internet.
