Research On The System Of Criminal Compulsory Medical

With the law of china’s criminal procedural procedure in 2012, criminal compulsory medical procedures was established in a chapter specifically, and made it into the fifth part of the special procedure. Thus, our country’s criminal compulsory medical have the procedure law matching its substantive law finally, then break the situation that our country’s criminal compulsory medical have no procedure law and lack of operability. Not only promoting the establishment of our country’s criminal compulsory medical, but also developing the legal system of our country.However, our country’s criminal compulsory medical is still in an initial stage, compared with the foreign country whose system already developed completely. There still have some place which is not perfect in the design of the system. Especially with the time goes by the procedure of criminal procedural law from the year of 2012, more disadvantages of the system have been exposed. For example, in the aspect of substantive law, the system’s object is narrow, and its suitable conditions need a more clearly defines. And in the part of the procedure law, the system need more explicit about its rules also, such as identification procedure, the trial details, remedy procedure and other aspects.Therefore, this paper takes some fundamental theory such as the concept, nature, theoretical basis as the basic point of research on the criminal compulsory medical. It compared and referenced the foreign country’s experience on their compulsory medical, and analyzed the present situation and disadvantages. Then, it tries to discuss the suggestion about developing our country’s criminal compulsory medical. The research not only helped the system of criminal compulsory medical play its function, and also necessary for improving the legal system of our country.
