The Theory Of Civil Preservation System

A new law system, being the norm of adjusting social life, always come into being to meet the requirements of society. The civil act preservation system is the case. In 2012, the civil act preservation system is listed in Civil Procedure Law in the perspective of the basic law for the first time, which is a big leap in legislation. However, it is not difficult to find out that relevant provisions concerning the civil act preservation system in Civil Procedure Law is too monotonous through analyzing the content of act preservation. In order to make the civil act preservation system function efficiently, we must accelerate its improvement to meet the needs of society. In this paper, relevant theory of the civil act preservation system is introduced. And suggestions are made by combining relevant legislations inside and outside of the country and analyzing defects of existing laws to make the system function.This paper is divided into following 4 parts by the author:In the first part, the main related concepts,theory and content of the civil act preservation system are listed. And the author has described the theory she agrees with. Then the author has introduced the revised content of the civil act preservation system and put forward her own viewpoints on controversial issues. Finally, the value of this system is introduced.In the second part, the civil act preservation system of some representative countries outside the country is analyzed and the special and advanced parts of the system are extracted.In the third part, the problems of the revised content of the civil act preservation system this time are put forward and main reasons are elaborated.In the fourth part, some measures of improving the civil act preservation system are put forward according to the problems found in previous content. In the meantime,some suggestions are made combining some practical experience in our country and foreign countries. These suggestions are based on the situation of our country, in hope of avoiding unnecessary problems, pursuing scientific and rational system in the process of refining the civil act preservation system.
