Research On The Problem Of Application Of Criminal Law Of Network Rumors Behavior

The emergence of the network rumors behavior is accompanied by the rise of the network. Compared with the traditional rumors behavior,the social harm of the network rumors behavior is more serious. So it is necessary to use legal means to regulate the network rumors behavior, especially use the criminal law to combat the network rumors behavior which serious violate the civil rights and the social order. On the basis of china and foreign experience, the author try to find a way to solve the matters in the application of criminal law.This thesis is divided into three parts, in the first part we will discuss the concept, the characteristics and the hazards of network rumors behavior, and try to classify the behavior of the network rumors behavior by different criteria, then introduce the civil, administrative and criminal liability of the networks rumor behavior may cause.On the basis of introduce the actual case, we will researches the different criminal charges in the crime of network rumors in the second part. And we will discuss some matters in application of criminal law, especially in the crime of defamation and crime of pick quarrels and provoke troubles.The third part of this thesis, on the basis of the foreign experience, we will try to find a way to solve the matters in application of criminal law, including additional charges and improve charges, and so on, in order to adapt to the change trend of the network rumors behavior and fight against the crime of network rumors.
