Research On Criminal Law Protection Of Grassland Resources

As an important ecological resources, grassland has been damaged continuously in recent years. Grass land problem has been paid close attention in modern society. The necessity of criminal law protection of grassland resource is not only to fight against crime, but to implement grassland laws and to ensure the ecological balance.In the field of Chinese criminal law, the Crime of illegal occupation of agricultural land plays a unique role in the protection of grassland resources. But in the judicial practice of grassland resources protection, it is failed to achieve the effective protection of grassland resources,because there are many defects in setting the criminal facts.This paper based on the necessity of criminal law protection of grassland resources and legislative evolution,and research the problems in this crime,The goal of the paper is to achieve effective protection of grassland resources through the perfection of the crime.This article has three parts.The first part deals with the value of criminal law protection of grassland resources and the legislative evolution, it discuss the value of criminal law protection of grassland resources in specification、theory、 practice、management and goal aspect,and reviwe the process in which grassland become the crime object in the crime.The second part analyse the problems existing in the criminal punishment of grassland damage, including plot fuzzy into sin,punishments lack,simplistic range of sentence,not the only object of crime.The third part put forward improvement measures against the problems, including comparing and using foreign criminal legislation for reference, setting up the crime of damaging grassland resources alone and improving the punishment regulation,putting the basic property destruction of grassland as sentencing basis,releasing the judicial case to guide trial practice, strengthening the connect and cooperation of the judicial organs and the administrative organs.
