Dilemma Of Visitation Execution And Path Of Resolution In Law

Visitation right shows the development of human civilization and the human care. The achievement of visitation right not only meets the needs of emotional communication between parents and children, but also has a significant impact on the mental health of children and their development of social personality. In judicial practice, however, the visitation rights, which derived from human nature and protected by law, are difficult to achieve. They often rely on the enforce to achieve, which is really a tragedy., It is quite difficult to achieve the implementation of visitation rights because there are many features about visitation cases including the special nature of the subject, difficult operability of execution, the complexity of the case, changes in content, long-term nature and complexity of the case. Based on work experience, the author gives five typical cases,to correspond with the main scope of visitation rights, the exercise of rights of access, the relationship between visitation and child support disputes, the suspend of visitation rights and enforcement of visitation. I hope my proposed solutions can helpful to the judicial practice.
