The Study On The Implementation Of The Criminal Legal Aid In The Grassroots

The criminal legal aid system is to provide legal aid for the criminal suspect or the defendant who don not have authorized defender because of their financial difficulty or their special.The aim of the system is to assure the human rights and the justice.It has been 20 years since the modern criminal legal of our country was built. The criminal legal aid has become the focus since the new criminal legal is carried out.The author believes that we should pay more attention to perceiving and learning the implementation of the criminal legal aid and make it to the theory in order to improve the criminal legal aid system in our country.Since the legal aid agents are set up according to the right of the jurisdiction of the courts in our country, there should be difference in the implementation of the criminal legal aid of agencies at all levels.Based on the implementation of the criminal legal aid in the grassroots(the counties and the districts) and four areas in Zhuzhou, the implementation situation of the criminal legal aid is investigated and studied in this article.There are four sections in this articles. The first section introduces and analysis briefly the the implementation situation of the criminal legal aid in the center of Zhuzhou at the first level and point out the characters and problems. The second section analyzes the main problemsin the criminal legal aid of the grassroots from three aspects, including the system, the deviation of the criminal legal aid from the society and the development bottleneck.The third section is about the survival environment of the criminal legal aid. The implementation of the criminal legal aid can not exist or develop without the existing judicial environment. We must think about the environment so we can solve the problems completely.The fourth section is to conceive to build the public defender in our country which will be suitable for our country. So the existing problems in the criminal legal aid can be solved and the criminal legal aid system can be improved.
