Study On The Scope Of The Heritage

The scope of the heritage is an important part of the inheritance system.It has great realistic and theoretical significance to conduct a detailed study on the scope of the heritage. It not only provides theoretical guidance for justice practice but also gives important reference for the revision on the inheritance law.The article starts with defining the concept of heritage,introducing the different views of the concept of heritage in domestic scholars.The focal point lies in exempting “legal “of heritage from definition and I agree with the judgment that the heritage includes positive and negative property.Through introducing the scope of heritage in the main continental law countries and common law countries,I summarize the similarities and differences in the two law systems which can provide legislation reference for the construction of the scope of heritage in our country.With the development of the society,the controversy about the scope of heritage is more than before.Mainly discusses whether the right to the contracted management of land,rural residence land,network property and frozen belong to the scope of heritage.In order to promote the scope of the heritage,I analyze the deficiencies of the current legislation. At last,it forms specific legislation items.
