Article 14 th of the price law of China operator price discrimination offering at first, Marketing manager who supply for the same goods and services for others with the same condition charge for different price. It is outside the law for managers. Article 17 th of the Anti-monopoly law defines discrimination as, without good reason, charge different price for the same trading party discriminatory treatment in transaction prices or other trading conditions. Law present the illegality of price discrimination, but not clearly defined. Price law of China has no limitation for position of managers who charge for different price, Anti-monopoly law defined discrimination as without just cause for different price. Because of the legislation is not clear, resulting problems in price discrimination.There is a difficulty in determining, Division of competencies between law enforcement agencies of price discrimination price discrimination is exacerbated by the uncertainty of regulation more difficult. By price deals, Price discrimination ultimately damage the interests of consumers, protection of price discrimination. To solve these problems, using methods of the comparative study after a reference foreign price discrimination legislation as well as the application, combined with the legal norms in our price, corresponding studies determination of price discrimination, antitrust regulation on price discrimination and put forward a proposal.
