Legal system of minimum wages,scholars generally believed to have originated in the 19 th century, New Zealand and Australia. New Zealand issued a "labor coordination and Arbitration Law" in 1894,establishing a minimum wage system. Victoria, Australia followed in 1896 by the world’s first to a special law on the minimum wage,minimum wage legislation has become the beginning. Today, nearly a minimum wage legislation has become the most developed countries after centuries of labor law is an important legal system. Legal system of minimum wages is defined by the legislature in accordance with legal procedures enacted to protect workers perform normal after labor obligations, the employer must pay a minimum remuneration,making workers enough to sustain their survival and the necessary support their families minimum fee of a system. Minimum wage is the national legal system to intervene in the wage distribution companies to ensure that workers get normal remuneration of an important legal system. It will not only be able to guarantee that workers acquire the basic wage equity,but also from the macro economy and social stability of the role of regulation, in violation of the legal system of minimum wages,must be subject to legal sanctions.Our legal system of minimum wages started late,but has been made progress steadily,our country enact the "Labor Law" Chapter V stipulates that the state implement a minimum wage guarantee system in 1994. "Minimum wage" has come into a testing phase,more than 20 years,this system implements a certain extent,the rational allocation of labor wages,labor protection of vulnerable groups,safeguard the legitimate rights and interests of workers and social of fairness and justice,but also to promote the reform of the economic system. But compared to other countries,there are still some deficiencies. This paper selects the United States,Britain,France and Japan four countries,by analyzing the current situation of the four national minimum wage legislation in this legal system,the development of institutions and procedures specific to the minimum wage,the minimum wage basic types,the minimum wage adjustment mechanism,evaluation mechanism and enforcement mechanisms and penalties,in contrast to the status quo several angles of minimum wage legislation my legal system,draw our legal system needs to introduce a minimum wage law for special protection,and on the need to develop models to improve the tripartite mechanism, adjustment factors added ability to pay the minimum wage and corporate connotation reference factors to regulate and establish a comprehensive and reliable evaluation mechanism,and finally need to be regulated in the implementation of the legal system of minimum wages,changing labor security department "does not tell ignore.The style of law enforcement initiative to help workers involved in litigation,and actively safeguard the legitimate rights and interests of workers,the employer violates the legal system of the minimum wage to be more severe penalties. I hope by suggesting these areas,making China the legal minimum wage system to be more robust,more deterrent,especially for low-income workers to maintain full rights of workers,add splendor for the real goal of a harmonious society.
