Associated with the multiplicity of views required by public interest, legislative control over China has been subtilized and diversified in recent years. Participation of experts in legislation as a means of public service has developed gradually with increasing attention from people. It plays an important role in Chinese legislative activities even until now. Inviting and electing experts from various fields to legislative activities not only represent the needs to reform the legislative system along with the social trend,but also emphasized the result of integrating theory with practice and adapting western institutions. Therefore, including more experts to the legislative activities does have practical objective and meaning, as it intensifies the legislative authority, improves the quality of legislation, and thereby promotes a fair and democratic legislation.To illustrate, attendance of experts in legislative activities essentially means recruiting experts through various public ways on the basis of retaining the original principles of legislation. Along with the accumulating experience, it has gained approval from differe ntsocial sectors. Additionally, constitution and legislative laws have provided legal basis for experts’ participation. So far, China has three major representatives in the legislative study. The earliest one is legal council that possesses proficient knowledge and rich exp erience, and offers professional advisory to legislature. The second one is legislative ass istant. This system is more widely used in western countries, which is based on the com plexity and maturity of the legislative body. The other one is investigative organization. With distinctive importance and advantages, all three representatives advanced the paths that experts can take part in the legislature.Nevertheless, there are still lots of problems in Chinese legislative activities, including the ambiguity of legal status for experts and the incompleteness of the established laws. Specifically, the problem is that how can experts stay neutral, representing the public int erests and handling problems of legislature with out any bias. It is critical that China has no laws against those who have been bribed by self-interest companies and organizatio n. This paper aims to analyze the current situation and problems on by experts to participate in the legislative activities, the solution to find the specific problems, and to further improve the expert to participate in the legislative activities to propose the countermeasure and the conception of.
