Research On Several Issues Regarding To Child Pornography On The Internet

With the development of the Internet technology, the situation of Online Child Pornography Crime (which is referred as OCPC)is getting worse, which not only disrupts public order and morality, but also impairs the children’s physical and mental health as the actors in the pornography. To deal with the severe situation of such crimes and limit the spread of information of the children pornography, the international organizations and the countries all over the world start to modify the criminal law system and utilize technical and administrative methods.This paper starts with an introduction of the global situation of OCPC, aiming at analyzing the uptrend and social damage of such crimes, which leads to the necessity of the research. Then the paper demonstrates current situation of the regulation systems and practical methods from four aspects:the legal interest which the OCPC violates,the definition of the online children pornography, the boundaries of crime type and the technical and administrative methods.The last part analyzes the defects of current Chinese legislation, and expect to fix the effects and establish a criminal law system adapted to the national conditions with the theory and practice of the foreign countries. In the meantime, through combining the technical methods and the advanced experience which the foreign countries strike the OCPC with the national conditions of China, this paper expects to establish the Internet administrative regulations system, enhance the communication and cooperation between Chinese government and the Internet industrial subjects, establish and complete the self-regulatory systems.The children are the future of the country, which the children pornography hurts deeply. The purpose of this paper is that through the research on the OCPC, we could provide the models and advice to build the relevant criminal systems and administrative regulations of the online pornography, finally provide a safer online environment for the children, prevent them from the harm of the OCPC and strike the OCPC more effectively.
