In recent years, with the growing of China’s economy, a large number of technology and equipment was drawn into rural development, which make agricultural labor easier, thus creating a large number of surplus labor. But there are not enough jobs for the labor, so they have to go to the city to find jobs, which result in a nationwide wave of migrant farmers. These migrant workers are young farmers, they have children. But the high cost of living in cities, the instability of their work environment, and household factors that limit the terms of their children to school, hey had to leave their children to stay in the rural, and asked other people to look after their children. These children have a same name-rural left-behind children.These rural left-behind children initially quietly lived in rural areas, but with the development of society and the rapid spread of the media, the left-behind children reports increased gradually, and there are a lot of problems in life, education, safety for the children. Especially the safety, a lot of left-behind children personal safety can not be guaranteed, drowning, electric shock, be violations occur from time to time. After a careful study of this group of children, you can find that in most of the rural left-behind children were not living with their parents, being taken care of by other relatives and friends, due to various reasons, there are certain problems in the care of left-behind children, lead to lack of left-behind children care in a certain extent. And care deletion caused the problems in life and physical and mental health for the children. Children are the new force and the next generation of successor to build our country. As left-behind children in rural areas are one of the vulnerable groups of children, they need more attention and help from the society. Therefore, this paper use comparative analysis, logical analysis and other methods, combining of sociology, psychology and other disciplines, in view of the current our country rural left-behind children’s custody mode and existing problem of guardianship, and put forward the rural left-behind children guardianship system conception and suggestion. The thesis is composed of six chapters altogether.The first chapter is Introduction. The introduction includes of research background, significance and the related literature summary. It is intended to introduce the dynamic of domestic research on rural left-behind children.The second chapter is the overview of guardianship of children left behind in rural. This chapter firstly introduces the related concepts of rural left-behind children on the time and quantity of their parents and the definition of rural left-behind children’s age,and the specific concept of left-behind children in rural areas has been given. Secondly, it introduces the basic concept of guardianship, the nature of guardianship, and several theories on monitoring, and so on.The third chapter is the analysis of the types and the guardianship of children left behind in rural. This chapter firstly introduces the types of guardianship for rural left-behind children, The current rural left-behind children guardianship types generally have relatives guardianship, single parent guardianship, peer monitoring, self care and school guardianship. Secondly, the left-behind children’s a series of consequences about living, learning, mental health, safety caused by the current guardianship mode was summarized.The fourth chapter is about the problems of guardianship. This chapter is divided into two parts, the first part is the existing problems in the guardianship relation. The second part is the existing problems in the monitoring system.The fifth chapter mainly introduces the foreign minors guardianship system. First it introduces France and Germany minors guardianship system belong to the mainland legal system, then introduces England and American minors guardianship system. Then enlightenment for our country was discussed.The sixth chapter discusses the construction of monitoring system of children left behind in rural. Firstly it clear central guiding ideology of rural left-behind children’s guardianship. Secondly is to improve the Commission guardianship system. Finally is to establish guardianship supervision mechanism.
