At the background of the judicial justice, concrete understanding its connotation must stand by two respects including the judicial organs and the parties. A criminal-civil case provides a good opportunity for study. But the theme of Criminal-civil cases covered so vast, it is easily to get lost from a macro level study, so a suitable study is to research a concrete mechanism. This article chose incidental civil action as the research object by the empirical perspective to investigate the experience of law.This paper consists of six parts.The first chapter is the introduction, proceed with currently research of criminal-civil cases, to cut into incidental civil action as the research object, and carding the focus of the existing research, then from the research object to research methods, a brief introduction to the necessity and effectiveness of empirical study.The second chapter is related to the empirical material source of illustration, emphatically illustrates the two types of homicide cases which was chosen, and respond to the challenges that may occur.The third chapter is the preliminary summary and analysis of these materials, in order to display the concrete implementation of incidental civil action in the two types of homicide cases.With the help of the preceding chapter, fourth chapter sums up several characteristics of incidental civil action in the survey, and gives the corresponding explanation.On the basis of the foregoing, Fifth chapter focuses on several topics such as the selection of litigation mode, "spend money on punishment", compensation for death, and tries to give a more rational thinking and evaluation.Epilogue part has a brief summary on the methodology of this article, in view of the existing system of incidental civil action, it has refined the two more macro suggestions. In addition, I return to the theme of criminal-civil cases and gave my opinion.
