The new criminal procedure law has been officially introduced in January 2013. Illegal evidence exclusion system is first established at the legislative level, and the responsibility of exclusion of illegally obtained evidence extends to the investigation phase, which brings severe challenges to the duty crime detection work and influences the change of mode of investigation on duty crimes. Investigation on duty crimes encounters illegal evidence exclusion issue in every way. The new criminal procedure law and criminal procedure rules are also formulated relevant norms. But under the influence of the traditional concept of duty crime detection, today’s duty crime detection work also has many places the new criminal procedure law does not conform to, because illegal evidence exclusion system is at the initial stage and the new criminal procedure law itself also has some shortcomings. If these problems are not effectively addressed, the duty crime detection work will be influenced negatively.Proceeding from my crime investigation work practice, combined with new criminal procedure law on illegal evidence exclusion, this thesis is focused on the illegal evidence exclusion issue of duty crime investigation measures, legitimacy proving of investigation acts and the evidence review. The main content of the thesis is the six issues of duty crime trial strategy, technological investigation measures, full synchronization recording video system, investigation personnel appearing system, cases and evidence transferring of discipline monitored organ and the review before the end of investigation, which are often encountered in practice. The aim of the thesis is to solve the problems of investigation practice and legislative level and to formulate illegal evidence exclusion system of Chinese procuratorial investigation on duty crime.
