In recent years, China’s tourism industry has developed very fast. Among the social relations which were formed in tourism activities, the most common one is the legal relation of organized travel contracts. Disputes over the alteration and termination of organized travel contracts have increased sharply. However, research into organized travel contracts is scanty; the existing legislation concerning organized tour contracts is also inadequate. In practice, disputes typically arise when a traveler changes the subject of the contract before the trip and the travel agent modifies the contract without authorization. The main disputes concerning the termination of organized travel contracts revolve around the legal consequences after travelers have exercised their right of termination without any reason to get out of the contract and how to ascertain force majeure. This essay offers a critical analysis of the conditions under which a traveler can change the subject of the contract before the trip and how to deal with the consequences, as well as of the liability of a travel agent who modifies the contract without authorization. In addition, I discuss the scope of compensation for damage after travelers have exercised their right of termination without any reason to get out of the contract and how to judge force majeure.
