People’s Jury System Running Status- For The Poverty-stricken Ethnic Minority Areas To Analyze Samples

At present the study of people’s jury system mainly focused on the theory of grand narrative, which enable us to have a systemative understanding of the people’s jury system, the significance and the extraterritorial experience. Whereas, how does people’s jury system work in China’s judicial practice, especially in fundamental count practice? What is the effect? And the main part, judge, jury and the party has a better understanding of people’s jury system which we know little. Especially in ethnic minority areas and poor areas at the grass-roots level are much less exposed to the social focus on areas such as how to run a jury system, we know little about it.This article is based on the grassroots participation experience of empirical research, collecting a line of data, through intensive investigation, selection of a grass-roots court poverty-stricken ethnic minority areas in Hunan province of the people’s jury system running status quo. The whole text is divided into five chapters,the first chapter is introduction, mainly elaborating the writing background and research significance which briefly introduces the basic situation of sample area and using the research methods. The second chapter mainly analyzes the single way of the local elected people’s assessors are produced, like selected National People’s Congress on behalf of the cause and effect through investigating the selection mechanism sample areas. The third chapter on sample region jurors than poor situation, this paper investigates the local review mechanism, concrete analysis from the initiator to the problems existing in the jury to participate in the whole process of trial. The fourth chapter from three aspects such as the comprehensive management, training,examination management mechanism of local jury system was investigated,comprehensive management, training does not reach the designated position, has not set up corresponding appraisal mechanism is realistic problems of the sample area.The fifth chapter is the path to improve the people’s jury system in our country, for the problem analysed in the first three chapters, considering the difference of sample areas, I put forward my reform proposals on the assessor, selection and management.
