There exist some violence accidents during the house expropriation and compensation on state-owed land nowadays, which is harmful to the civil property right. Our country has recognized the severity of problem, and has been performed "The house expropriation and house compensation system on state-owed land" (Hereinafter referred to as "the House Expropriation System"), but its content is simple and confined to the principle provisions, which is less benefits to guide practice. No doubt the problem is serious, which not only gives much chance to the house acquisition department, but also transfers the relationship of the government and the ownership of the house. Besides, as the country speeds up the urbanization process, the size of the house acquisition will continue to expand, it is obvious that the country cannot ignore these people. This article is based on these data through access method, questionnaire method and literature analysis method, then making use of SPSS15.0 analyzes the statistics and carries out the research.The article is mainly divided into the following four departments:The first department mainly introduces to how to find the problem, sample evaluation, research design,and research significance, first, analyzing the disadvantages through the literature review and judicial review and putting forward the innovation place; next, expressing the science of selecting the NC district and Y community; then, introducing the research design, including the basic information of the respondents and the sampling methods; finally, instructing theoretical significance and practical significance.The second department mainly summarizes "the House Expropriation System" problems in terms of the theory.The third department mainly analyzes the realistic operating conditions of "the House Expropriation System". The result of the research shows that public interest cannot be listed at all, opinion polls can not be implemented, citizens are lack of the knowledge of judicial relief, the standard which identifies most of the citizens is diversification, the process of the house acquisition unit is fuzzy, the enforcement main body is not accurate, the real estate appraisal institution is not accepted, the legal responsibilities are simple, the risk assessment body’s content and form are monotonous and so on.The fourth department mainly discusses the perfection paths and reasons about "the House Expropriation System". From the perspective of the applicable situations of the public interest, the group and scale of the public opinion, promoting the knowledge of judicial relief, setting the standard about identifying most of the citizens, the house acquisition unit comes into being through the bidding, the judicial organs and government carry out forced evictions, the house prices uses the average of the real estate appraisal institution, add the legal responsibility main body and refine the rule of law, add the risk assessment body’s content and form.
