So we must establish and perfect the laws and regulations guarantee system, to promote the implementation of the program and the execution objection system perfect,by scientific method. The procedural relief and substantive relief to pay equal attention to, to protect the lawful rights and interests of the parties, safeguard the dignity of the law and the status, the smooth realization of the purpose of legislation to protect people-oriented in China’s. The author has long been engaged in civil execution, this paper studies the execution objection system in China in two aspects of China’s civil execution objection system, overseas execution objection system for reference, analyzes the implementation in practice of civil execution objection system, and discusses the problems in the system of the civil execution, in particular to the execution objection the main reason to file, and set the execution objection review system is not perfect, is not satisfied with the results of the relief is not clear, the objection ignores the plaintiff qualification, the person subjected to execution objection filed third people missing problem, the debtor dissidence law is not shown.
