The Research Of Criminal Reconciliation System

With the development of the mitigation of criminal policy in China,the criminal reconciliation system has long been a focus of criminal procedure law educational world. Judicial practice in China,all localities have also to explore and develop different ways of criminal reconciliation.The scope of the criminal reconciliation, condition,procedure and effect are made specific provision in revised "Code of Criminal Procedure" in 2012,This makes the criminal reconciliation system in our country has been further development.This paper is divided into three chapters.The first chapter of criminal reconciliation system overview,a brief introduction to the ideological and social foundations of the criminal settlement system in ancient China,analyzes the fusion between criminal reconciliation system and three principles of the modern criminal law.Criminal reconciliation system in our country is in line.For the modem criminal law, criminal reconciliation is also one of the important part of,and there is no contradiction with the traditional criminal law.In the second chapter,the author introduce the foreign related patterns,like the victim-offender, family group conferencing,sentencing circles,and respectively from the concept of restorative justice into,the special protection of minors,and communities and other social forces to participate in analysis to reflect on the Criminal reconciliation System to identify three patterns of foreign we can learn from.Section as the focus of this article,in the third chapter to the new changes of the criminal procedure law,the current situation of the criminal reconciliation system in China was analyzed,and puts forward some suggestions under the framework of criminal reconciliation in our country for cases of minors scope expanding,criminal reconciliation perfecting supervision mechanism, establish and perfect the system of community correction,and the community mediation system,in order to China’s criminal reconciliation system in our country in the current judicial system,give full play to its due function.
