With the rapid development of education, a large number of university graduates are going to enter the society and want to find a job. During the time of graduation, many institutions will arrange these graduates to major-related companies for exercitation, or the graduates initiatively apply the companies they prefer for exercitation in order to be a worker afterwards, resulting in the number of interns in many fields also increasing steadily, accompanied by a variety of legal issues frequently happened during the job. Personal injuries are especially prominent in certain coefficient internship positions. But because of the limitations inherent in the law itself, our laws fail to define personal injury problems during the internship period and thus having led to the legal disputes and legal responsibilities among interns, schools and internship companies cannot be settled in accordance with the law, which makes the interests of the interns cannot get due protection and relief. Solve the problems of rights protection of interns’ personal injury is very important which is especially expounded and studied in my paper. In the article two successful cases in reference to protect interns’ legal rights and which extract the dilemma that interns how to look for legal protection. I will analyze the existing legal provisions, to explore the problems existing at present, and give my advice about the specific improvement proposals of our interns’ accident compensation system of laws and regulations.
