On Application Of Inductive Investigation In Retailed Drug

In order to fight against drug crime effectively,inductive investigation has become a common practice in many countries and has achieved remarkable results. In recent years,our country also began to use the inductive investigation in drug crime cases investigation, and retailed drug trafficking cases occupy a larger proportion in drug crime cases,the inductive investigative has been used frequently in retailed drug and a series of problems are highlighted.However,our legislation and judicial is lack of specific legal system to solve these problems and specification.In this paper, from the practical perspective, analysis of the current situation and the existing problems of drug crime cases of inductive investigation in China, to explore the specific conception of legal regulation of the inductive investigation in retailed drug trafficking.The first part takes the three true case in the law enforcement practice as the breakthrough, raises problems of application of inductive investigation in retailed drug trafficking.Reflect the actual situation of China’s retailed drug trafficking cases of inductive investigation, that the inductive investigation is a double-edged sword, if does not regulate the inductive investigation,it will tend to abuse the inductive investigation and violations of the rights of the citizens.The second part takes experimental investigation on the applicable situation of the use of inductive investigation in the retailed drug trafficking in B District,of the City A,proposed the existence problem of inductive investigation in B District,of the City A. At present, here is no uniform law on inductive investigation of drug crime in our country;the scope of application of inductive investigation is ambiguity;the process of inductive investigation is lack of effective supervision and restriction provisions; the existence of the phenomenon of abuse of inductive investigation.The third part proposes the concrete conception inductive investigation regulation of retailed drug trafficking.Clear the application principles and detailed specific measures of inductive investigation. Including the principle of inductive investigation;clear the scope and object of inductive detection;improve and perfect the secret service management;control the procedure of temptation investigation;provide the remedy measures of illegal inductive investigation and the measures of safeguards of the advocate’s right of cross examination.
