Since an amended Criminal Law imposed harsher punishments on drunken drivers,the problem of whether drunk driving is all incriminating sparked a huge controversy in the theoretic and practical field.The fundamental solution to the problem of whether drunk driving is all incriminating is the establishment of effective evidence rules to clear the admissibility rule of evidence of drunk-driving offenses,thereby achieving the non-criminalization.China’s the current admissibility rule of evidence of drunk-driving offenses stipulated in the opinions on issues concerning the laws applied to handling criminal cases on drunk driving,which was issued by the Supreme People’s Court,the Supreme People’s Procuratorate and the Ministry of Public Security in 2013.But there are many problems in it.Thus I try to put forward my own ideas,in order to achieve the goal of the accurate identification of drunk driving offense,the punishment of drunk driving and the protection of human right.
