Legal Evaluation And Research On Behavior Of Cash-out

Credit card has been generally accepted as a convenient payment for any purchase and entered into people’s life in recent years. However, relevant crime has occurred with the rapid development of credit cards. Especially, the behavior of cash out has even come in public and industrialized that disturbs the running order of our credit markets. Appeasement with these criminal activities will effect the long-term, healthy and steady development of credit markets. In view of the facts that it is difficult to combat crime without statutory authority, the enactment of relevant explanations have filled the blank of criminal laws. As a result, the legality of the explanations was challenged and it also drew more and more attention about its application.In this paper are five contents mainly. First chapter introduces definition, three ways and legal relation of cash out in practice. Second chapter further analyzes the causes and possible risk of harm of cash out. Third chapter demonstrates the current legal regulation in our country and the evaluation of different legal entities with criminal laws. Forth chapter compares legal regulation about cash out in other countries, be worth to draw lessons from. And the last part gives suggestions about enacting and improving rules and regulations in the perspective of criminal laws.
