The Legal Analysis Of The Underlying Assets Of Chinese Asset Securitization

As a financial innovation which involves several branches of knowledge like law, accounting and finance etc., asset securitization has experienced great development in the last 40 years since it has the characteristics of asset credit financing, structured financing and off-sheet financing. The core and most important link of asset securitization is the underlying asset. After a brief introduction of the meaning and development of asset securitization, I will analysis the types and "true sale" of underlying assets in the perspective of law. Then, the thesis will use the US and Taiwan as reference to give some legislative suggestions for asset securitization in our country. On the basis of the current regulation of China, with reference to the related regulations of developed countries(regions), this thesis will provide some advice to perfect our securitization legal system.
