The Study Of Litigation System Of Environmental Public Interest

Environmental issue has become a thorny issue that needed to be resolved urgently.The disadvantage of putting economic development as a priority,ignoring the interests of environment, is becoming increasingly serious that hindered China’s development of economic and society.and even a direct threat to the rights and interests of the broad masses of people’s life,health and property. The current methods of China’s environmental protection are not effective enough to solve the serious problem. We need to learn the successful environmental public interest litigation from Western countries,establishing and improving China’s special environmental public interest litigation system. This paper discussed the theoretical definition of environmental public interest litigation, investigating the development and practice situation of the system in Europe, the United States, Japan, India and other countries, analyzing the current situation of environmental public interest litigation.in China, and trying to make a specific design of how to build and improve our environmental public interest litigation system.Chapter 1, this chapter discusses the basic theory of environmental public interest litigation, including the concept and aspect of public interest litigation, defining the concept,aspect and values of environmental public interest litigation.Chapter 2,this chapter examines the environmental public interest litigation’s theoretical study abroad and the legislative, judicial and practice of United States, Germany, Sweden, Japan, India and other countries.Chapter 3, this chapter analyzes the current situation of environmental public interest litigation in China.Chapter 4, this chapter is a scheme of establishing and improving our environmental public interest litigation system, mainly discusses the direction and optional path and specific methods of building our environmental public interest litigation system.
